Covenants, Requirements & Restrictions

- Architectural review and approval required for all new home
construction.
Setbacks: 20’ front, 20’ rear, 5’ side, 20’ corner
- Minimum conditioned square footage 1300 sf and 1500 sf
- Building facades should exhibit detailing as approved by the
developer. Corner lots should have side entry garage.
- Landscape plans
are required for approval by Developer.
- Shade trees are
required in the front yards of all houses. Size, species and
placing shall be designated by the developer.
- Roof is to be
asphalt shingle.
- Brick should not
be repeated on adjacent houses.
- Mailboxes are of
one design designated by the developer. No deviations are
allowed.
- Out buildings
are strictly regulated and are subject to architectural review.
They must be constructed of materials and colors to match the main
house. This includes playhouses. No prefabricated
storage bldgs are allowed.
- Home additions,
decks, arbors, porches, gazebos, garden structures, swimming
pools/ spas, large landscaping projects, statuary or other
improvements which can be seen from the street or other lots are
subject to Architectural review.
- Dog/ animal pens
are strictly regulated. They must be hidden from view from
the street and other homes or lots. Architectural review required.
No more than two domesticated pets may be kept on or inside
anyone’s property.
- Fences -are
strictly regulated. Only certain styles are allowed.
Minimum standard privacy fence is a “4x4 Good Neighbor Fence” with
treated posts and cedar or cypress boards. Details are
available from the Developer. No chain link fencing is
allowed. Architectural review is required for all fencing.
- Walks and drives
– Washed aggregate finish is not allowed on walks and drives.
Broom finish concrete is preferred. Brick or stone insets,
patterned concrete, and stained and scored concrete are some
examples of allowed paving upgrades.
- Tree removal –
All trees at existing homes are subject to Architectural review
before they can be removed.
- Grading and
drainage – Architectural review must approve any proposed changes
in the grading and drainage of a homeowner’s yard. The
homeowner may not adversely impact an adjoining neighbor or common
area with alteration of drainage pattern.
- Parking – No
permanent on-street parking is allowed. All parking of
vehicles must be on the lot. No Boats, RV’s, trailers,
trucks one-ton and over, or other large vehicle is allowed to be
parked on the street or the lot for over 24 hours. Adjacent
storage facility is available for this.
- Appearance
standards – Certain appearance standards are established for the
subdivision including but not limited to yard upkeep, signage,
satellite dishes and antennae. Homeowners Association – is part of
Harbor Gate. All lot owners are members
